This Consumer Health Data Privacy Policy supplements the Nitrility, Inc. (doing business as Kled.ai) Privacy Policy. This Consumer Health Data Privacy Policy applies to personal data defined as “consumer health data” subject to the Washington My Health My Data Act, the Nevada Health Privacy Act and similar U.S. laws governing consumer health data.



What is Consumer Health Data?


“Consumer Health Data” is generally defined as personal information that is linked or reasonably linkable to a consumer and that identifies the consumer’s past, present, or future physical or mental health status.



Our Collection of Consumer Health Data


You may choose to provide, transmit, or upload certain content to Kled (“Kled,” “we,” “us”), including documents, files, text, video, photos, audio, and other content (“Submitted Content”). We license, sell, and/or otherwise provide Submitted Content to third parties for their own purposes, including third parties that use this content to train, fine-tune, develop, and improve their AI models (collectively, the “Services.”). While we may specifically request certain types of content (e.g., photographs containing specific content), you as the user ultimately decide what content you provide, including whether you provide any content that may be considered Consumer Health Data, such as:


  • Information about your individual health conditions, treatment, diseases or diagnosis

  • Information about your social, psychological, behavioral, and medical interventions

  • Information about health-related surgeries or procedures

  • Information about use or purchase of prescribed medication

  • Bodily functions, vital signs, symptoms, or measurements relating to a health status

  • Information about diagnoses or diagnostic testing, treatment, or medication

  • Gender-affirming care information

  • Reproductive or sexual health information

  • Biometric data

  • Genetic data

  • Precise location information that could reasonably indicate your attempt to acquire or receive health services or supplies

  • Data that identifies you seeking health care services

  • Other information that is derived or extrapolated from non-health information that we process to associate or identify a consumer with the data described above


Please do not provide any content, including Consumer Health Data, that you do not want to be licensed, sold, and/or otherwise provided to third parties for their own purposes (including to train AI models).



Sources of Consumer Health Data


We collect Consumer Health Data directly from you when you choose to include any such data in Submitted Content.



How We Use Consumer Health Data


We collect, process and use Consumer Health Data to provide you with the Services (e.g., to sell, license, or otherwise provide Submitted Content to third parties so that you get paid). We may also use Consumer Health Data for the following purposes:


  • Promoting safety, integrity and security

  • Communicating with you

  • Other essential business operations that support our ability to provide you with the Services, such as understanding (in aggregate) usage of the Services and conducting research and development

  • Complying with our legal obligations


We may also collect, process and use Consumer Health Data for other purposes with your consent or authorization. We do not collect Consumer Health Data over time and across different websites or online services when you use the Services.
